Nash Electrical — Terms & Conditions

1. General

a) These terms and conditions apply to all electrical services provided by Nash Electrical and form part of any quotation, agreement or contract between Nash Electrical and the Client.

b) By accepting a quotation, instructing works, or permitting works to commence, the Client confirms acceptance of these terms and conditions in full.

c) Nash Electrical reserves the right to update these terms and conditions from time to time. Any changes will be confirmed in writing and will apply to works quoted or contracted after the date of issue.

2. Installation Work

a) All electrical installation work shall comply with BS 7671 (18th Edition) including any amendments in force at the time of the works.

b) All works shall comply with all applicable Building Regulations in force at the time of installation.

c) Where work extends or modifies existing circuits, the quotation assumes the existing installation is in a satisfactory condition and suitable for connection. Any remedial works required to bring the installation to a safe or compliant standard will be charged additionally.

d) Unless otherwise stated, cables will be concealed within the building fabric or voids. Where impracticable, cabling will be surface run neatly using trunking or conduit.

e) Floor coverings may be lifted where necessary; reinstatement will be to a reasonable standard, however specialist refitting or cosmetic repair is excluded.

f) Chases will be filled to within approximately 2mm of finished plaster level where agreed. Final plastering and decoration are excluded.

g) Reasonable measures will be taken to protect the property and maintain cleanliness during works.

h) The formal quotation will outline the anticipated programme duration.

i) The Client shall provide access to water and electrical power free of charge.

3. Exclusions

a) Moving furniture and clearing access routes is excluded.

b) Builder’s work beyond minor drilling and chasing is excluded unless stated.

c) Final decoration and making good is excluded.

d) Waste removal and disposal is excluded unless expressly stated.

4. Variations

a) All variations must be agreed in writing prior to commencement.

b) Variations requested after commencement may incur additional cost and time.

c) All agreed variations will be charged in addition to the original contract sum.

5. Pricing

a) Prices assume continuous and unhindered access.

b) Standard working hours are 08:00–17:30 Monday to Friday.

c) Additional works may be charged at up to £85.00 + VAT per hour plus materials.

d) Quotations remain valid for 30 days from the date of issue.

e) All prices are exclusive of VAT unless explicitly stated otherwise.

6. Compliance

a) All works shall comply with BS 7671 and Building Regulations. Any requested deviation must be confirmed in writing by the Client.

7. Risk and Title

a) Risk passes to the Client upon delivery.

b) Title to all goods remains with Nash Electrical until payment is made in full.

c) The Client is responsible for insuring the property during works.

8. Warranty

a) Nash Electrical warrants its workmanship to be free from defects for a period of twelve (12) months from the date of invoice.

b) All materials and equipment supplied and installed by Nash Electrical are covered by the respective manufacturer’s warranty, the duration of which varies by product but will be not less than twelve (12) months, unless otherwise stated.

c) Manufacturer warranties are subject to the terms and conditions of the manufacturer and do not cover damage arising from misuse, neglect, accidental damage, fair wear and tear, or unauthorised modification or repair.

d) This warranty does not apply to defects arising from equipment supplied by the Client, alterations carried out by third parties, or abnormal operating conditions.

9. Payment

a) Unless otherwise agreed in writing, payment is due within two (2) days of invoice date or on completion, whichever is sooner.

b) Interest may be charged on overdue accounts at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

c) The Client shall be liable for all reasonable costs incurred in recovery of unpaid sums, including legal fees.

d) A deposit (typically 40%) may be required for works exceeding £500.

e) Stage payments may be required for works exceeding thirty (30) days duration.

f) Electrical certification, reports and Building Control notifications will be released only once all sums due have been paid in full.

10. Cancellation and Missed Appointments

a) Where the client is a consumer and the contract is agreed off-premises or at a distance, the client has the right to cancel within fourteen (14) days in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

b) Outside of the statutory cooling-off period, the Client must provide a minimum of 24 hours’ notice to cancel or reschedule a confirmed appointment.

c) Failure to provide adequate notice may result in a cancellation charge to cover committed time and travel costs.

d) Where Nash Electrical attends a site and is unable to carry out or complete the works due to the client’s failure to provide access, site readiness, or required permissions, a minimum call-out charge will apply.

11. Client Responsibilities & Site Conditions

The Client shall ensure:

a) Safe and unrestricted access to the site at the agreed time.

b) A safe working environment in accordance with Health & Safety legislation.

c) All working areas are clear and ready for installation.

d) Any asbestos or hazardous materials are identified and managed prior to works.

Any delays or additional costs arising from failure to meet these requirements may be chargeable.

12. Dispute Resolution

a) In the event of a dispute, both parties agree to seek resolution through direct communication in the first instance.

b) If a resolution cannot be reached, mediation shall be the preferred method of formal resolution before any legal proceedings are commenced.

13. Limitation of Liability

a) Nash Electrical shall not be liable for any indirect or consequential loss, including loss of profit, loss of use, or business interruption.

b) Total liability shall be limited to the value of the contract, except in cases of death or personal injury caused by negligence or where liability cannot be limited by law.

14. Force Majeure

Nash Electrical shall not be liable for delay or failure to perform caused by events beyond reasonable control, including adverse weather, supply chain disruption, DNO or statutory authority delays, strikes, illness, or restricted site access.

15. Insurance

Nash Electrical maintains appropriate insurance cover including public liability insurance. Details are available upon request.

16. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.

17. Severability

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Use of This Website

a) Access to and use of the Nash Electrical website (www.nashelec.co.uk) is provided for general information purposes only and is subject to these terms and conditions.

b) Whilst we endeavour to ensure the website is available at all times, Nash Electrical accepts no liability for any disruption, unavailability, or errors on the website.
